Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your access to and use of the website at vacancyhawk.com and the VacancyHawk vacancy-prevention intelligence service (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Not a Consumer Report

VacancyHawk is a market analytics platform for property owners, property managers, and real-estate investors. VacancyHawk does not produce consumer reports under the Fair Credit Reporting Act (FCRA) and is not a tenant screening service. Our reports are intended to help property owners and operators evaluate their own properties or properties they are considering acquiring โ€” not to evaluate tenants or applicants for credit, employment, housing eligibility, insurance, or any other FCRA-regulated purpose. You agree not to use the Service for any FCRA-regulated purpose.

3. No Investment, Legal, or Tax Advice

Reports, scores, pricing strategies, and other content produced by the Service are provided for informational purposes only and do not constitute investment, legal, tax, accounting, or real-estate advice. We make no representations about the accuracy or completeness of public-record data sourced from third parties. You are solely responsible for your investment and operational decisions and should consult appropriately licensed professionals before acting on information from the Service.

4. Data Sources & Aggregation Statement

VacancyHawk analyzes data from publicly available government records (county assessors, court eviction filings, foreclosure filings, building permits) and commercial APIs (RentCast, Rentometer, and similar). VacancyHawk does not use or share nonpublic competitor rental data between property owners. We score properties and markets using only public information.

We make no warranty that public-record data is current, complete, or free of errors. Some data may lag actual market or filing status by days, weeks, or months depending on the source. Always verify material facts with primary sources before acting.

5. Permitted Use

You may use the Service for lawful purposes consistent with these Terms. You agree NOT to:

  • Scrape, harvest, or otherwise systematically extract data from the Service without our written permission
  • Resell, sublicense, or redistribute reports or other Service output without our written permission
  • Frame, mirror, or republish material portions of the Service
  • Use the Service to compile data for FCRA-regulated decisions about individuals
  • Interfere with the operation of the Service or attempt to gain unauthorized access
  • Use automated tools (bots, scrapers) against the Service except as expressly permitted by our robots.txt and API terms
  • Misrepresent affiliation with VacancyHawk or impersonate any person

6. Subscriptions & Billing

Paid subscriptions are billed in advance via Stripe. Monthly plans renew monthly; annual plans renew annually. Lookup packs are one-time purchases that do not auto-renew.

  • You may cancel a subscription at any time from your account or by emailing us; cancellation takes effect at the end of the current billing period.
  • We do not provide pro-rated refunds for partial periods, but if you cancel within seven (7) days of an initial subscription purchase and have not yet used the Service in any material way, email us at wesley@vacancyhawk.com and we will refund that initial payment.
  • We may change pricing for future billing periods by giving at least thirty (30) days notice via email.

7. Intellectual Property

The Service, including its design, code, copy, scoring methodology, brand, and aggregated outputs, is owned by VacancyHawk and is protected by U.S. and international intellectual-property laws. You receive a limited, non-exclusive, non-transferable license to use reports produced by the Service for your internal business purposes. We retain all other rights.

8. Forms & Submissions

If you submit a property address, ZIP code, Offering Memorandum, or other information to the Service, you grant us a non-exclusive license to use that information to produce the reports and analyses you've requested and to improve the Service. We treat customer data per our Privacy Policy.

9. Third-Party Links & Services

The Service may link to third-party websites or rely on third-party data providers (RentCast, Rentometer, county data portals, Stripe, etc.). We are not responsible for the content, accuracy, or practices of third parties. Your use of any third-party service is subject to that service's own terms.

10. Disclaimers & Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. VacancyHawk does not warrant that the service will be uninterrupted, error-free, or that any data or score will be accurate, complete, or current.

To the maximum extent permitted by law, VacancyHawk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or relating to your use of the service. VacancyHawk's total cumulative liability arising out of or relating to these terms or the service shall not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the amount you paid VacancyHawk in the twelve (12) months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold VacancyHawk and its affiliates, officers, and contractors harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Denver County, Colorado, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated to active subscribers by email. Continued use of the Service after a change indicates acceptance of the revised Terms.
